INTRODUCTION Sections 90-94 of the Canada Transportation Act, require a person wishing to construct or operate a railway, passenger or freight, to apply to the Agency for a certificate of fitness. A certificate of fitness will only be issued once the Agency is satisfied that there will be adequate third party liability insurance coverage for the proposed construction or operation.
